US Court Orders Freedom of Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to answer alien smuggling allegations, he was detained in immigration custody.
In her decision, the court noted that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

The court challenge involve disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
