The NBA legend Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and novelty within the sport emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Team Investment and a Competitive Drive

The owner disclosed operational insights of his 23XI team, saying he put in $40 million of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination through a new lens.”

Central Issue: Charter Agreements and Renewal Demands

At issue is the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other major leagues with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters clamoring for a glimpse or a photo of the sports legend.

Spearheading the Fight

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is unlawful to keep two hands on the wheel.

Ultimately, the resistance against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me adding a third car boosted our odds of winning,” he said, sharing that he purchased another franchise late in 2024 for $28 million amid the legal dispute. “So I took the plunge.”

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the timing of the signature deadline was problematic.

She said, the team founder first attempted to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, that’s the number.”
